Keep Nine

RESOLUTION SUPPORTING THE KEEP NINE AMENDMENT TO THE UNITED STATES CONSTITUTION

WHEREAS, the United States Constitution provides no specific instruction for the number of justices that constitute the Supreme Court of the United States; and

WHEREAS, for over 150 years, the Supreme Court has consisted of nine justices; and

WHEREAS, during the nation’s history Congress has changed the number of justices, both increasing and decreasing, seven times prior to 1870 for the purpose of gaining political advantage; and

WHEREAS, the practice of “packing the court” for political advantage greatly decreases confidence that the Supreme Court exists as an essential element of America’s system of checks and balances, which guarantees and protects a citizen’s constitutional rights; and

WHEREAS, many House Democrats recently introduced a bill to add four justices via the 2021 Judiciary Act; and

WHEREAS, in order to prohibit a future Congress or President from manipulating the number of Supreme Court justices for political advantage, more than 200 Members of the U.S. House and Senate have endorsed the Keep Nine Amendment to the U.S. Constitution that simply states: “The Supreme Court of the United States shall be composed of nine Justices”; and

WHEREAS a bipartisan total of more than 1000 state and federal elected officials have now endorsed the Keep Nine Amendment; and

WHEREAS national support for the Keep Nine Amendment includes the Republican National Committee, National Federation of Republican Women, California Federation of Republican Women, Freedom Works, My Faith Votes, Eagle Forum, Tea Party Patriots, American Legislative Exchange Council and Americans for Limited Government; and

WHEREAS, recent polls have shown that voters support a “Keep Nine Amendment” by more than a 2-1 margin.

THEREFORE, BE IT RESOLVED that the Sacramento County Republican Party urges the support and enactment of the “Keep Nine Amendment to the United States Constitution”.
